Terms and Conditions

In consideration of B R Silver (hereinafter referred to as "Kanak Loans", which expression shall include where appropriate its affiliates, successors and assigns), the user agrees to be bound by these Terms and Conditions as amended, supplemented and/or superseded by Kanak Loans from time to time.

These Terms and Conditions/Terms of Service apply to any kind of loan including but not limited to the following Loans:

  • Personal Loan
  • Vehicle Loan
  • Consumer Loan
  • Other Loans [viz. Gold Loan, Home Loan, Business Loan, Marriage Loan, Medical Loan]

These terms of use (hereinafter the "Terms") establish an agreement between Kanak Loans having its principal place of business at FIRST FLOOR, 12/19, WEA KAROL BAGH, West Extension, New Delhi, West Delhi, Delhi, 110005 and you, and shall govern your use of Kanak Loans proprietary risk evaluation and measurement software system (“Kanak Loans System”) and the services set out in these Terms (“Service”) rendered by Kanak Loans. Supplemental terms may apply to specific Services, for example, arrangements for a specific occasion, movement or advancement, and such supplemental terms will be disclosed to you regarding the appropriate Service(s). Supplemental terms are in addition to, and shall be deemed a part of, these Terms for the purposes of the applicable Service(s). Supplemental and/or amended terms shall prevail over these Terms in the event of a conflict with respect to the applicable Services.

Kanak Loans may, at its sole discretion, amend the Terms from time to time. Unless otherwise set out herein, amendments will be effective upon Kanak Loans’s posting of such updated Terms at this location or the amended policies or supplemental terms on the applicable Service(s). Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.

1. Eligibility/Condition Precedent

Kanak Loans may grant or continue to grant the loan to the borrower if the following conditions are fulfilled or continued to be fulfilled:

  • If you are an individual you must be at least 18 years old.
  • If you are a non-individual you must be duly authorized (by such non-individual entity) to agree to these Terms.
  • You must be solvent.
  • You represent and warrant that you are capable of entering into these Terms and performing the obligations set out hereunder.
  • You must be a citizen of India.
  • You must be a human being to enter into these Terms.
  • Any use of Kanak Loans System by ‘bots’ or other automated tools or methods is not permitted under this Agreement.
  • Your application form shall have been accepted by Kanak Loans in the manner as prescribed.
  • All the required documents legal or otherwise as may be required by Kanak Loans shall have been completed and signed to the satisfaction of Kanak Loans.
  • All the primary and secondary evidence of the document as demanded by Kanak Loans must be duly furnished.
  • There shall exist no potential event for default and all representations and warranties contained herein and in the application form and in the loan agreement or elsewhere shall be true.
  • All other conditions precedent as Kanak Loans may require or impose have been fulfilled to the satisfaction of Kanak Loans or otherwise have been duly complied with.

2. Account Set Up

Account registration requires you to submit certain information such as your name, address, mobile phone number and age and any unique identifier that may be issued to you by Kanak Loans. You agree that you have provided from start and maintained accurate, complete, and up-to-date information in your Account. Failure to maintain accurate, complete, and up-to-date Account information may result in your inability to access and use Kanak Loans Systems and/or the Services and/or the final referral for banking or financial that you seek or result in Kanak Loans's termination of this agreement with you.

You are solely responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times. Unless otherwise permitted by Kanak Loans in writing, you shall only use and operate one Account with Kanak Loans.

You acknowledge and agree that any misuse of your Account for reasons not attributable to Kanak Loans shall be to your account and you will be liable for any and all liabilities incurred as a result of such misuse. You thus assent that any data put together by you for Account set-up might be utilized by Kanak Loans as per the privacy policy which is deemed to be part of these Terms.

3. Service

The Service establishes your access to Kanak Loans System, the verification of information you have provided on the Kanak Loans portal and assessment by Kanak Loans of your creditworthiness, and subject to Kanak Loans determining (in its sole and absolute discretion) that it is appropriate, your ability to submit an application (“Credit Facility Application”) for short term credit facility (“Advance”) to a duly licensed entity who has partnered with Kanak Loans (“Kanak Loans Partner”) and use of such other functionalities of Kanak Loans System as permitted by Kanak Loans.

  • Kanak Loans is under no obligation to reveal to you (including your nominees, heirs and successors) its assessment of your creditworthiness at any point.
  • You can submit a Credit Facility Application through Kanak Loans Systems, but approval is subject to dynamic evaluation by their risk algorithm and various parameters.
  • No assurance or guarantee is made that you will be allowed to submit an Application for each Advance you seek.
  • Kanak Loans or a Partner may verify any information supplied by you, including employment details and credit background.
  • Service does not guarantee disbursal; the final decision is with the Kanak Loans Partner.
  • You agree to provide further documentation as required by law or policy.
  • You'll need to execute a loan/credit facility agreement with the lender if a loan is granted.

Repayment:
You must repay the Advance along with all interest, charges and fees to the Kanak Loans Partner in such manner as prescribed.

Services End-Point:
Services of Kanak Loans end when you are connected to the credit provider.

Separate Transactions:
Advance is a distinct transaction between you and the Partner; any dispute is between you and the Partner.

Collection Authorization:
You permit Kanak Loans to send payment reminders and use your content/information for their authorized collection services as outlined in the agreement.

Network Access and Devices:
You are responsible for internet/data access and necessary devices.

License:
Subject to your compliance, Kanak Loans grants you a limited, non-exclusive, revocable, non-transferable license in India to access their system for personal, non-commercial use.

Restrictions:

  • Do not use Services except as expressly provided.
  • Do not provide third parties with access.
  • Do not post/spam/abusive content.
  • Do not remove copyright/proprietary notices.
  • Do not resell, reverse engineer, decompile, exploit, or share service in unlawful ways.
  • Do not impersonate another or host, display, upload, or share illegal/harmful content.

Kanak Loans can monitor use for compliance.

4. User Generated Content

You are solely responsible for any content (data, text, images, files, etc.) that you upload or share; Kanak Loans makes no guarantee of accuracy or safety of user content and use of such content is at your risk.

Maintain backup of important information externally, as Kanak Loans does not guarantee against inadvertent damage, loss, or corruption of user data.

5. Limited Warranty

Certain risks are inherent in internet data transmission. Kanak Loans uses industry-standard security but does not guarantee Services are virus- or security breach-free at all times. The Service is provided “as-is” and “as available”. No guarantee of uninterrupted, error-free, or suitable operation for critical situations is provided. No additional warranties are provided except those expressly stated.

6. Limitation of Liability

IN NO EVENT SHALL Kanak Loans BE LIABLE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE FOR ANY LOSS OF PROFITS, BUSINESS, CONTRACTS, OR REVENUES, LOSS OF OPERATION TIME, INCREASED COSTS OR WASTED EXPENDITURE, GOODWILL OR REPUTATION, OR FOR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES.

7. Indemnity

You shall defend, indemnify, and hold harmless Kanak Loans, its officers, directors, employees, and agents, from and against any and all claims, damages, losses, liabilities, debts, and costs (including reasonable attorneys’ fees), arising from:

  • Your use of the Service;
  • Your violation of Terms;
  • Any third-party rights violation;
  • Any claim that your content caused damage.

Your indemnification obligation survives termination of this Agreement.

8. Privacy

Use of the Service is subject to Kanak Loans’s Privacy Policy. By using the Service, you consent to collection, transfer, and processing of your information as per applicable laws and their privacy guidelines.

9. Assignment

You shall not assign this Agreement without express prior written consent of Kanak Loans.

10. Arbitration and Governing Law

This Agreement is governed by Indian laws. All disputes are subject to exclusive jurisdiction of courts in New Delhi, India.

All notices/communication under this Agreement shall be in writing and sent to:

12. Severability

If any term, condition, or provision of this Agreement is found invalid/unlawful, it will be severed but the rest will remain fully enforceable.

13. Waiver

No waiver of a breach constitutes a waiver of other breaches, and no waiver is effective unless in writing.

14. Force Majeure

Kanak Loans is not liable for failure/delay due to causes beyond control (e.g., strike, riot, natural disaster).

15. Other Products and Services Terms of Use

Kanak Loans also provides additional services:

Exclusive Club:
Add-on feature to access exclusive offers from partners/affiliates. Not directly sold by Kanak Loans.

Trading Connections:
Access to partner trading apps and their offers.

16. Credit Card & Other Financial Services

Kanak Loans may share user leads with partnered brands (e.g., major Indian banks) for credit cards/financial products, and users agree to receive communications from such partners as per their eligibility. Your details may be retained and used by these institutions, and by agreeing, you consent to receive all related communications as provided.

17. Entire Agreement

These Terms plus supplements constitute the full agreement. Any additions/modifications are only valid if in writing by Kanak Loans. Updates are posted on the terms and conditions page and are not notified individually.

Kanak Loans positions itself as a fintech solution to provide quick, convenient, and transparent credit access in India.

Any modification to terms will be updated on their website.
