This Privacy Policy (“Policy”) is in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, applicable RBI guidelines and regulations, and describes the information collected from you (hereinafter referred to as “You”, “Your” or “User”) on your visit to the Platform (defined below) and use of the Platform; the manner and procedure of collection of such information; use, storage, and disclosure thereof; the rights and choices available to you; and how B R Silver including its online platform(s) under Kanak Loans (Collectively "Platform") manages your data.

This Policy constitutes a legal agreement between You, as the User of the Platform, and B R Silver as the owner of the Platform. For clarity, User shall mean any person who visits, uses, and/or transacts through the Platform. You are permitted to use the Services available on the Platform only if you are a natural person, a citizen of India, and at least eighteen (18) years of age.

By visiting or accessing the Platform and voluntarily providing us with information—including, but not limited to, personal and sensitive personal information—you are consenting to our use of such information in accordance with this Policy.

Disclaimer: We reserve the right to modify or update this Policy at any time, so please review it frequently to understand the latest policy adopted by us. Changes and modifications to this Policy will take effect immediately upon posting on the Platform. Any continued use of the Services shall signify your acceptance of such updated Policy.

1. COLLECTION AND STORAGE OF PERSONAL INFORMATION

Personal Information collected from the Users is securely stored at servers located in India by B R Silver. We use reasonable safeguards to preserve the veracity and security of the information collected against loss, theft, unauthorized access, disclosure, reproduction, use or amendment. We use reasonable security practices and procedures as mandated under applicable laws for the protection of your information. However, you understand and accept that there is no guarantee that data transmission over the Internet will be completely secure and that any information that you transmit to us is at your own risk. We assume no liability for any disclosure of information due to transmission errors, unauthorized third-party access to our Platform and databases, or other acts of third parties, or acts or omissions beyond our reasonable control, and you shall not be entitled to hold us responsible for any breach of security.

2. PERSONAL INFORMATION COLLECTED

To provide you with a smooth and secure journey on our Platform, we collect your personal information including but not limited to the following:

a. All information uploaded by the User on our Platform at the time of registration, which includes your personal information like first name, last name, email address, date of birth, mobile number, address with PIN Code.

b. As a digital fintech marketplace partnered with RBI-approved lenders, we facilitate connections between you and our partners to enable access to products such as loans and credit cards. In processing your application, we collect the following information with your explicit consent:

  • Education details
  • Details of parents
  • House ownership details
  • Salary account details
  • Name of the bank where you have a primary account
  • Details regarding your employment, including years of experience
  • Details of income
  • Name of the current and previous employers
  • Details regarding years/months completed with the current employer

Additional Data Collected:

1. Selfie: This app uses your camera to capture selfie images for uploading necessary documents during the face-match process in the KYC journey.

2. Location: We collect your location details to verify your address and ensure serviceability for your loan application. This helps us assess risk, prevent fraudulent activities, and provide a seamless loan experience. Rest assured, location data is only accessed when the app is in use and is not collected in the background.

3. Any other information as required by RBI-approved lenders

Except as explicitly mentioned in this policy, we do not access or collect any mobile phone resources such as files, media, contact lists, call logs, telephony functions, or biometric data.

3. DISCLOSURE / SHARING OF PERSONAL INFORMATION

a. With Lending Partners: Personal Information collected from you is shared with our RBI-approved lenders for the purpose of processing your application, with your explicit consent.

b. Marketing and Promotional Purposes: By registering on the Platform, you authorize Kanak Loans (including its RBI-approved lenders and affiliates) to send text and email alerts regarding your login details and any other service requirements, including promotional mails and SMS—even if you are registered under DND or DNC or NCPR services. Your authorization shall be valid as long as your account is not deactivated or unless you withdraw consent. To withdraw consent, please contact info@kanakloans.com.

c. Disclosure to Third Parties: We do not share your personal information with third parties for commercial purposes contrary to, or in violation of, this Policy. Where required, information may be shared with our RBI-approved lenders, affiliates, employees, and service providers, solely for the purposes outlined in this Policy.

4. RIGHT TO WITHDRAW CONSENT

Kanak Loans respects your rights over your personal information. If, at any time, you wish us not to retain your personal information, or if you ask us to delete or remove your personal information, we will do so without further questions. You may unsubscribe from Kanak Loans communications by contacting info@kanakloans.com.

If any of your information is inaccurate, incomplete, or outdated, you have the right to submit corrected details. Upon notification, we will promptly update our records within one (1) month. Please ensure that the information you provide is always accurate and up-to-date.

5. DATA SECURITY

Kanak Loans understands the importance of your personal information and therefore uses the highest applicable standard to protect information collected from you. We employ appropriate security measures to address any suspected data security breach.

However, Users acknowledge that no information transmitted over the internet is completely secure, and there is always a possibility of such data being breached even with the highest security in place. We cannot guarantee absolute security. You are responsible for maintaining the confidentiality and security of your login ID and password, and should not share such credentials with others.

6. DATA STORAGE AND INFORMATION SECURITY

Your information is stored in access-controlled facilities with restricted access. Data transmitted over the internet is protected by encryption (e.g., SSL). We store and process your personal information on Amazon Web Services (AWS) cloud infrastructure, with safeguards including firewalls, encryption, and access control. These measures help protect your information against loss, theft, unauthorized access, disclosure, modification, or misuse.

Our security practices align with applicable laws and industry standards. We maintain a comprehensive information security policy with managerial, technical, operational, and physical controls.

All information you provide to us is stored on servers located in India. If there is a security breach involving your information, we will take all necessary steps to prevent further misuse, mitigate risks, and notify you electronically so you can take action to protect your interests.

7. DATA RETENTION AND DESTRUCTION

We retain your information only for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable law, with appropriate safeguards. Other information collected and stored is anonymized and aggregated irreversibly. By providing your information, you explicitly consent to our use of such anonymized data for analytical and other purposes, except as restricted by applicable law.

9. AMENDMENT OF PRIVACY POLICY

10. JURISDICTION AND GOVERNING LAWS

For any dispute arising out of this Policy, the Courts at New Delhi, Delhi shall have exclusive jurisdiction.

11. CHANGE IN PRIVACY POLICY

a. Kanak Loans will periodically inform its users, at least once every year, of its rules and regulations, privacy policy, user agreement, and any changes in this respect.

b. Kanak Loans may terminate user access or remove information from its platform for any non-compliance with this Policy, user agreement, or applicable law.
